| Republic of Croatia County Court of Zagreb President of the Court Zagreb, February 26, 1999 Chronology of Case Procedures On April 20, 1998, the District Attorney in Zagreb brought charges against Dinko Sakic through the investigative judge, based upon Article 120, paragraph 1 of the Criminal Code of the Republic of Croatia. On April 21, 1998, the investigating judge ordered that investigations be undertaken and that arrangements be made to take Dinko Sakic into custody. Based upon the above ruling, the Ministry of Justice of the Republic of Croatia petitioned the Republic of Argentina to extradite Dinko Ljubomir Sakic. The executive authority of the Republic of Argentina decided after court proceedings held in the Federal Court in Dolores to extradite Dinko Ljubomir Sakic. As a result of this ruling, Dinko Sakic was delivered to the legal authorities of the Republic of Croatia on June 18, 1998. The accused was called upon to answer to criminal charges before the investigative judge on June 19, 1998. In the presence of his defense lawyer, he stated that he understood the charges brought against him and that he would exercise his legal right to refrain from answering questions or to present a defense. Forty six witnesses were heard during investigative procedures and substantial documentation from various sources was compiled. One of the main sources of information was archive materials from the Croatian State Archives and the Museum of History, as well as archive materials of the State Commission used in determining crimes committed by occupiers and their collaborators. Also used was documentation compiled by organs of the Independent State of Croatia, and any parts which might concern the actions of the defendant in the Stara Gradiska and Jasenovac camps and the events connected to these camps were considered. Other documentation came from the work of the Jewish Community of Zagreb, archive materials submitted to the Ministry of Justice by the government of the United States, the Simon Wiesenthal Center and the Federal Ministry of Justice of the Republic of Yugoslavia, and documentation from the archives of the International Red Cross obtained by the State Archives of the Republic of Croatia. |
